ED cannot keep filing chargesheets to keep accused in jail: Supreme Court

The Supreme Court criticised Enforcement Directorate for denying default bail through continuous chargesheets, resulting in extending investigations and thus indefinite jail time. Justices Sanjiv Khanna and Dipankar Datta expressed concern over prolonged detentions without trial, focusing on the case of Prem Prakash linked to illegal mining. According to CrPC, a person arrested for an offense is entitled to default bail if the investigating authorities fail to complete the investigation or submit a chargesheet within the specified timeline, typically 60 or 90 days.
